Binding framework law (Ley 31814) implemented through regulation, with a sector-by-sector compliance rollout through 2028 and a parallel national AI strategy

Country Overview

Peru has one of Latin America's more developed binding AI frameworks. Ley N.° 31814, enacted July 5, 2023, declared the promotion of AI development of national interest and established general principles (safety, ethics, transparency, sustainability, non-discrimination, protection of human rights) alongside a mandate for risk-based classification. Its implementing regulation, Supreme Decree N.° 115-2025-PCM, was approved on September 9, 2025 and entered into force January 22, 2026, naming the Secretaría de Gobierno y Transformación Digital (SGTD) — part of the Presidencia del Consejo de Ministros (PCM) — as the national technical-regulatory authority for AI. Compliance obligations are being phased in by sector: health, education, justice, security, and economy/finance from September 10, 2026; transport, commerce, and labour from September 10, 2027; production, agriculture, energy, and mining from September 10, 2028; and all remaining uses from September 10, 2029.

In May 2026, INDECOPI's Sala Especializada en Eliminación de Barreras Burocráticas issued Resolution N.° 0219-2026/SEL, clarifying which specific obligations under the AI Law's regulation do, and do not, constitute unlawful bureaucratic barriers on private-sector AI developers and deployers — an indication that implementation is already generating friction with businesses. Separately, on May 1, 2026 the government approved the National Artificial Intelligence Strategy 2026–2030 (ENIA) via Ministerial Resolution N.° 152-2026-PCM, a mandatory guidance instrument for public entities and a referential one for the private sector, again led by the SGTD. AI has also become a live issue in Peru's 2026 general elections (first round April 12, 2026): lawmakers proposed penalties for AI-generated deepfakes in campaigns, and the Jurado Nacional de Elecciones (JNE) deployed AI-assisted fact-checking tools to monitor disinformation across social platforms.

Current Direction

Tightening

Peru has moved from a promotional framework law (2023) to a binding, sector-phased implementing regulation now in force, plus a formal national strategy approved in May 2026 — a steady tightening of the compliance perimeter. At the same time, INDECOPI's May 2026 ruling on bureaucratic barriers shows real pushback from the private sector on how far those obligations should extend, and Peru's political environment (a new government took office following the April–June 2026 general elections) adds some uncertainty about how consistently implementation will be pursued through the following presidential term.

Research Ecosystem

The Grupo de Inteligencia Artificial de la Pontificia Universidad Católica del Perú (IA-PUCP) is described by the university as the country's leading AI research center, working on computer vision, pattern recognition and applications in health, security, environment and law. PUCP also runs a dedicated Grupo de Derecho e Inteligencia Artificial studying the legal and regulatory dimensions of AI. A fuller national picture of Peruvian AI research output beyond PUCP has not been independently verified here.

Major AI Companies

Krealo (Credicorp)

Venture and innovation arm of Credicorp, Peru's largest financial group; has backed AI-adjacent fintech investments regionally, including in Ecuador's Jelou.

Cloud Infrastructure

Frontier AI
No domestic frontier developer

Chip access
Import-reliant; no domestic advanced-chip fabrication

AWS

Major cloud provider for Peruvian enterprise and public-sector workloads.

Microsoft Azure

Cloud provider used across Peruvian enterprise AI adoption.

Google Cloud

Notable Gaps

4
  • Named political/technical leadership

Available reporting did not confirm a current, up-to-date named head of the SGTD as of mid-2026; Peru's frequent cabinet turnover makes this difficult to verify without more recent sourcing.

  • Frontier AI developers

No frontier foundation-model developer is headquartered in Peru; domestic activity centers on applied research (e.g., IA-PUCP) and compliance with the new regulatory regime.

  • Independent AI-specific think tanks

No dedicated AI-policy think tank was identified in available sources; legal and policy commentary comes mainly from law firms and university-affiliated researchers.

  • Cloud/data-center infrastructure detail

Public data on hyperscaler data-center presence specific to Peru (as opposed to the wider Andean region) was limited in available sources.

Whether the AI Law's regulation imposes unlawful bureaucratic barriers on private-sector AI developers

INDECOPI's May 2026 ruling on the AI Law's implementing regulation reflects a live tension between compliance obligations and business costs.

▾

Resolution N.° 0219-2026/SEL from INDECOPI's barrier-elimination tribunal clarified that some obligations under Supreme Decree 115-2025-PCM are lawful regulatory requirements while others may restrict economic activity in ways that qualify as unlawful bureaucratic barriers. This suggests that, even with a relatively mature legal framework compared to regional peers, Peru is still working out in practice how far AI compliance obligations can extend before they are challenged as excessive by industry.

Electoral deepfakes and AI-driven disinformation ahead of and after Peru's 2026 general elections

Concerns about AI-generated deepfakes and disinformation shaped part of the debate around Peru's April–June 2026 general elections.

▾

A congressional bill sponsored by Carlos Anderson proposed fines (20 URP, over S/10,000) for producing or disseminating deceptive AI-generated electoral content, alongside a mechanism for the JNE to request immediate takedown of manipulated audiovisual material; it does not appear to include criminal penalties. Separately, the JNE deployed its own AI-assisted monitoring tools to track manipulated content on TikTok, X, Facebook and streaming platforms. Whether these measures meaningfully reduced disinformation during the election, and what happens to the deepfake bill going forward, was not confirmed in available post-election reporting.
